A.    GENERAL


JAMAICA AIR SHUTTLE LIMITED is an Airline operating under the Air Operators Certificate of AIRWAYS INTERNATIONAL LIMITED issued by the JAMAICA CIVIL AVIATION AUTHORITY (JCAA).

Jamaica Air Shuttle is a company registered and domiciled in Jamaica.

Jamaica Air Shuttle is a “Ticketless” carrier.

The Travel Receipt and the following Conditions of Carriage constitute the agreement between the Passenger and Jamaica Air Shuttle Limited for carriage on the carrier’s services. Please read this Agreement carefully.

Carriage is subject to the applicable tariffs, conditions of carriage and related regulations, which are available on request.

As a “Point To Point Carrier”, Jamaica Air Shuttle does not provide flight connections or baggage transfer to / from other Airlines.

Under no circumstance will Jamaica Air Shuttle accept responsibility or liability for missed connections or denied boarding by other Airlines.

Neither Jamaica Air Shuttle Limited nor any-one affiliated with the carrier, will be responsible for expenses incurred by passengers due to delayed or cancelled flights for reasons including, but not limited to the following: Weather, Mechanical, Technical, Customs, Immigration, National Security, Aviation Security, Acts Of God, Labour disruption or any other Force Majeure event.


Passengers paying for travel on Jamaica Air Shuttle using a credit card at our airport locations, must have the credit card present and also have a valid form of government/state issued identifcation  available for identification and verification purposes.


Please verify Flight Times prior to departure. Advertised Departure / Arrival times and Flight Routings are subject to change without prior notice.


When traveling Internationally, Passengers are reminded of their responsibility to be in possession of valid Passports or other accepted forms of identification; valid onward tickets to their country of residence or citizenship; and entry visas for foreign countries where required.


Passengers who do not conform with these requirements may be denied boarding by Jamaica Air Shuttle and other International Airlines; and they will have no recourse to Jamaica Air Shuttle to recover fines, damages, costs or other forms of pecuniary loss that may result.


It is a condition of acceptance of Passengers that they must fit comfortably in the Aircraft seat and be fully secured by a seat belt for take off, landing and periods of flight when the seat-belt sign is on. Any passenger who cannot fit into the passenger seat; or who cannot be adequately restrained by the seat belt cannot be accepted for travel on Jamaica Air Shuttle.

Acceptance for carriage of young persons, incapacitated persons, pregnant women, persons with illness or other people requiring special assistance is subject to specific prior arrangement with us on terms and conditions which may be advised by us from time to time.

 

OVER-RIDING LAW

These Conditions of Carriage are applicable unless they are inconsistent with applicable law in which event such law shall prevail.

If any provision of these Conditions of Carriage is deemed to be invalid under any applicable law, all other provisions of the Conditions Of Carriage shall nevertheless remain valid.

FARES / CHARGES & TRAVEL RECEIPTS

Travel is valid only for the person for whom it has been purchased. It is non transferrable.

Photo Identification is required for all Passengers 02 years old and over.

Seat availability is confirmed when full payment is received by the Carrier.

FARE IS NON REFUNDABLE, but may be credited to future travel to be undertaken within six months on Jamaica Air Shuttle’s “On Demand” services.

ALL PRICES ARE DENOMINATED IN UNITED STATES DOLLARS. YOUR LOCAL CURRENCY EQUIVALENT WILL BE CALCULATED ON THE BASIS OFAPPLICABLE RATES AS DETERMINED BY YOUR CREDIT PROVIDER ON THE DAY OF TRANSACTION IF PURCHASE IS BY LOCAL CREDIT / DEBIT CARD; OR AT THE PREVAILING EXCHANGE RATE EMPLOYED BY THE CARRIER IF PURCHASE IS IN CASH.

Jamaica Air Shuttle’s Travel Documents cannot be issued or endorsed for travel on other carriers.

Except as otherwise provided in these Conditions and such regulations as Jamaica Air Shuttle may make from  time to time, reservations are valid only for the flight(s),date(s) and route specified on the Travel Receipt.

Fares apply only for carriage from the airport at the point of origin to the airport at the point of destination, unless otherwise expressly stated. Your fare will be calculated in accordance with Jamaica Air Shuttle’s tariffs and fare categories in effect on the date of payment for travel on the specific dates and  itinerary shown on the Travel Receipt. Should you change your itinerary or dates of travel, this may impact the fare to be paid.

For fare levels so designated, Jamaica Air Shuttle will apply a change fee should a Passenger initiate a change in reservation from the original. In addition the difference between the fare paid on the original reservation and the fare available on the new date / time requested will also be applied.

Certain fares have conditions that limit or exclude the Passenger’s  right to change or cancel reservations.

 

SEATING

Jamaica Air Shuttle does not pre-assign seats on any of its flights. However, if you report to the boarding gate no less than thirty (30) minutes prior to flight departure and request pre-boarding for good reason the carrier will do its best to assist. Jamaica Air Shuttle reserves the right to assign or reassign seats at any time, even after boarding of the aircraft. This may be necessary for operational, safety or security reasons.

 

CHECK-IN & BOARDING

Jamaica Air Shuttle will not be liable to Passengers for any loss or expense incurred due to his / her failure to comply with the provisions of its regulations as they pertain to check-in and boarding.

Passengers must present a valid government/state form of identifcation upon check in for all flights.

Passengers must check in at least forty-five minutes before domestic flight departures and one hour and thirty minutes for International flights. With exception for flights departing from Santiago de Cuba which requires at least three hours before flight time.

Domestic Flights will be closed thirty minutes prior to flight's departure and forty five minutes for International departures. Passengers who present themselves for check in after these deadlines may be denied boarding and their applicable fare will be forfeited.

Passengers who do not show up for travel on Jamaica Air Shuttle flights on which they are booked, by the check-in deadline (NO SHOW PASSENGERS), will forfeit the fare paid for the journey.

 

BAGGAGE

EACH PASSENGER occupying a seat will be permitted ONE PIECE of CARRY ON BAGGAGE WHICH SHALL NOT EXCEED FIVE KILOGRAMS (11 LBS) IN WEIGHT AND MUST BE ABLE TO BE STOWED COMFORTABLY UNDER THE SEAT IN FRONT OF HIM / HER. ITEMS OF CARRY ON BAGGAGE MAY INCLUDE MENS’ AND LADIES HANDBAGS, LAPTOP COMPUTERS, BABY BAGS, CAMERA BAGS AND SMALL CARRY-ON BAGS WITH ITEMS OF CLOTHING AND PERSONAL EFFECTS. CARRY ON BAGS SHALL NOT EXCEED ANY OF THE FOLLOWING EXTERNAL DIMENSIONS 45 cm Long X 30 cm Wide X 15 cm High.

  • It should be noted that there are selected seats which cabin baggage cannot be accomodated, thus passengers seated in those who have carry-on baggage will be offered a courtesy baggage service, where it will be taken from the passenger at boarding, placed in a secure hold location and returned upon deplaning.


Any piece that exceeds the maximum allowable dimensions (unable to fit under the seat in front of the Passenger) or weight for carry-on luggage, will be taken from the passenger and placed in the Aircraft’s Hold as Checked Baggage.

FREE BAGGAGE ALLOWANCE: Each Passenger occupying a seat shall be allowed a total Free Baggage Allowance of 50 Lbs or 23 Kg. Both Checked Baggage and Carry On Baggage shall be weighed on check in for 'weight and balance' purposes.

POOLING OF BAGGAGE: Only members of an immediate family travelling together shall be allowed to pool baggage.

OVERWEIGHT: Jamaica Air Shuttle shall levy “Overweight” charges on a per Kilo basis. Applicable rates are available on request

SPACE AVAILABLE CARRIAGE OF EXTRA / OVERWEIGHT BAGS AND BOXES: No Checked Bag shall exceed total external dimensions of 62 Ins. and weight of 25 KG (55 Lbs). Second Checked Bags, Boxes and other Containers shall be accepted strictly on a SPACE AVAILABLE basis and carriage on the same aircraft as the passenger is not guaranteed.

Jamaica Air Shuttle accepts no liability for delays in forwarding Extra / Overweight / “Non Standard” Luggage.


The Passenger is advised to allow a minimum of 3 HOURS for baggage collection and rechecking when connecting to another carrier. In cases where a change of Airport is involved, for example where transfers between Tinson Pen Aerodrome and Norman Manley International Airport are must be undertaken, Passengers are advised to allow adequate connecting time to cater to the surface transit between Airports.


Passengers are reminded that there are security regulations in place governing the carriage of liquids and gels in Carry On Baggage. All travelers on Jamaica Air Shuttle are requested to familiarize themselves with the regulations of the National / Airport Authorities at all points on their Jamaica Air Shuttle itineraries; and to strictly observe these regulations in order to avoid delays and or inconvenience en-route.


Jamaica Air Shuttle recommends that passengers securely lock all items of Checked Baggage and place Identification stickers with Name and Contact details on the outside and inside. Valuables, electronic equipment and medications should not be checked in.

All Passengers on Jamaica Air Shuttle flights must take special care to positively identify their checked baggage before claiming it on arrival and removing it from the Arrivals Area.

JAMAICA AIR SHUTTLE WILL NOT ACCEPT  LIABILITY FOR
: Cosmetic damage to checked bags such as stains, nicks, scratches or dents; damage to protrusions such as pockets, wheels, locks, handles, zips etc; damage to, loss or spoilage of valuable, fragile or perishable items including, but not limited to lap top computers, other electronic equipment, jewelry, cash, negotiable instruments, precious metals, camera equipment, medical devices, medication or business / personal documents; or damage arising from the Carrier’s compliance with applicable laws, government rules and regulations; or from the Passenger’s failure to comply with same.

The following items are not suitable for carriage by air and they must not be included in Baggage:

a. items which are likely to endanger the aircraft or persons or property on board the aircraft, such as those specified in the International Civil Aviation Organisation (ICAO) Technical Instructions for the Safe Transport of Dangerous Goods by Air and the International Air Transport Association (IATA) Dangerous Goods Regulations.
b. items the carriage of which is prohibited by the applicable laws, regulations or orders of any state to be flown from, to or within;
c. items which are reasonably considered by Jamaica Air Shuttle to be unsuitable for carriage because they are dangerous, unsafe or by reason of their weight, size, shape or character, or which are fragile or perishable having regard to, among other things, the type of aircraft being used.
d. Explosives, incendiary devices and detonators.
e. Firearms and ammunition except strictly as prescribed under national law and Jamaica Air Shuttle’s Regulations.
f. Swords, knives, scissors, blades, cutlery, darts, syringes and other sharp objects and any item which in the carrier.s opinion could be used as a weapon  may be accepted as checked Baggage, at Jamaica Air Shuttle’s discretion, but will not be permitted in the cabin of the aircraft.


Jamaica Air Shuttle will refuse to carry as Baggage prohibited items as defined in Paragraphs a. – f. above.

Passengers are required to collect their Checked Baggage as soon as it is made available at their destination. Jamaica Air Shuttle will not accept liability for Checked Baggage that is not claimed and removed from the Arrivals Hall by the Passenger. Such Baggage will be turned over to the Airport Administration.

Only the bearer of the Baggage Claim Tag is entitled to delivery of the checked Baggage.

If a person claiming Checked Baggage is unable to produce and/or identify the Baggage by means of a Baggage Claim Tag, Jamaica Air Shuttle will deliver the Baggage to such person only on condition that he or she establishes to its satisfaction his or her right to the Baggage.

Jamaica Air Shuttle  may refuse to carry as Baggage any item reasonably considered by the carrier to be unsuitable for carriage because of its size, shape, weight, content, character, or for safety or operational reasons, or the comfort of other passengers.

At its sole discretion, Jamaica Air Shuttle may refuse to accept Baggage for carriage unless it is properly and securely packed in in suitable containers.

Passenger Baggage is subject to search and / or scan for restricted / prohibited items.

Jamaica Air Shuttle will not accept liability for loss of or damage to any Prohibited Item (as defined herein) that is removed from a Passenger’s baggage or confiscated.
NOTICE OF CLAIMS FOR DAMAGE OR LOSS OF CHECKED BAGGAGE

Acceptance of Checked Baggage by the bearer of the Baggage Claim Tag, without complaint and without completion of a Property Irregularity Report at the time of delivery, is prima facie evidence that it has been delivered in good condition and in accordance with the agreement for carriage,

If a Passenger wishes to file a claim  regarding Damage to or Loss of Checked Baggage, such claim must be submitted to Jamaica Air Shuttle as soon as possible and definitely no later than seven (7) days after the event of loss or damage, attaching a copy of the Property Irregularity Report. Unless there are extenuating circumstances, non submission of the claim and supporting documentation within this prescribed period shall invalidate such claim.


LIMIT OF LIABILITY FOR BAGGAGE CLAIMS


For Passengers travelling within Jamaica on the services of Jamaica Air Shuttle, the Carrier’s liability for loss or damage to Checked Baggage is limited to the equivalent of US$4.00 per Pound to a Maximum of US$200.00 per Passenger occupying a seat. Jamaica Air Shuttle will not be liable for loss or damage to Unchecked / Hand Luggage.

For passengers on a journey on the services of Jamaica Air Shuttle involving an ultimate destination or stop in country other than the country of origin are advised that liability for loss, delay or damaged baggage is limited under the Warsaw Convention or Montreal Convention depending on the route of travel. For travel governed by the Warsaw Convention, we will reimburse up to US$ 9.07 per pound to a maximum of 50lbs per checked bag (Maximum US$453.50 per checked bag). Baggage under the Montreal Convention is reimburse at a maximum value 1000 SDRs per ticketed fare paying passenger.

REFUSAL AND LIMITATION ON CARRIAGE

Jamaica Air Shuttle reserves the right to refuse carriage to a Passenger and / or his / her Baggage if one or more of the following circumstances occur or it is reasonably believed that the circumstance may occur prior to or during flight:

a. Denial of carriage or removal from a flight is necessary in order to comply with any applicable government laws, regulations, or orders;
b. the carriage of  the Passenger or his / her Baggage may endanger or affect the safety, health, or materially affect the comfort of other passengers or crew;
c. the Passenger’s mental or physical state or attitude or demeanour, including apparent  impairment from alcohol or drugs, presents a hazard or risk to the Passenger, fellow passengers, crew,  or  property;
d. the Passenger has committed misconduct on a previous flight;
e. the Passenger has refused to submit to a security check;
f. the Passenger has  not paid the applicable fare, taxes, fees or charges and refuses to comply when  reasonably requested to do so;
g. the Passenger has an  outstanding debt to Jamaica Air Shuttle for services previously provided by the Carrier and  for which payment was dis-honoured, refused or recharged; and satisfactory arrangements have not been made for settlement of same
h. the Passenger does  not appear to have valid travel documents and / or his or her identity cannot be established against documentation that is presented and the Passenger cannot prove that he / she is the person for whom travel was purchased.
i. the Passenger fails to observe our instructions with respect to safety or security.

 

If in the reasonable exercise of its discretion under the Rules stated in the above section  entitled “Refusal and Limitation On Carriage” Jamaica Air Shuttle refuses boarding to or removes a Passenger from one of its flights, the Carrier may at  its sole discretion cancel the remaining unused portion of  the Passenger’s Ticket and he / she will not be entitled to either further carriage by or a refund from Jamaica Air Shuttle. Jamaica Air Shuttle will not be liable for any consequential loss or damage purporting to result from any such refusal to carry or removal of the Passenger en route. Jamaica Air Shuttle may also initiate legal action against such Passenger for any damage incurred as a result of any of the above.

As an operator of Aircraft with less than Twenty (20) Passenger Seats, Jamaica Air Shuttle Limited is not required to carry a Cabin Attendant on its “On Demand” flights. Therefore, for reasons of passenger safety and convenience, the Carrier is unable to accommodate passengers whose mobility is severely restricted. Passengers with hearing and / or sight impairment; and those with restricted mobility (but who can board and deplane the aircraft slowly with assistance) will be accepted for travel provided that they are accompanied by an “able bodied” adult companion.

 

SMOKING and DRINKING and use of DRUGS

Passengers may not smoke and/or drink alcoholic beverages and/or use drugs in any part of an aircraft operated by Jamaica Air Shuttle. Failure to adhere to this regulation may result in severe criminal penalties being brought against such Passengers as well as all disruption costs being claimed against them by the carrier.
Inebriated Passengers are a safety and security risk in “Air-side” areas of Airports and on board aircraft. As a consequence, Jamaica Air Shuttle will deny boarding to any passenger who shows signs of mental or physical impairment as a result of use of an intoxicating substance.

 

CONDUCT ABOARD AIRCRAFT

If, in the reasonable opinion of Jamaica Air Shuttle, a Passenger conducts himself or herself aboard the aircraft so as to endanger the aircraft or any person or property on board, or obstructs the crew in the performance of their duties, or fails to comply with any instructions of the crew including but not limited to those with respect to smoking, alcohol or drug consumption, or behave s in a manner which the carrier reasonably believes may cause or does cause discomfort, inconvenience, damage or injury to other passengers or the crew, Jamaica Air Shuttle may take such measures as it deems reasonably necessary to prevent continuation of such conduct, including restraint. The offending Passenger may be disembarked and refused onward carriage at any point, and may be prosecuted for offences committed on board the aircraft. No refund for any unused portion of the Passenger’s ticket will be made by the Carrier.

 

ELECTRONIC DEVICES

For safety reasons, Jamaica Air Shuttle forbids or limits operation aboard the aircraft of electronic equipment, including, but not limited to cellular telephones, laptop computers, portable recorders, portable radios, CD players, electronic games or transmitting devices, including radio controlled toys and walkie-talkies. Operation of hearing aids and heart pacemakers is permitted.

 

REFUSAL OF ENTRY

If on an International flight performed by Jamaica Air Shuttle, a Passenger is denied entry into any country, such Passenger will be responsible to pay any fine or charge assessed or levied against Jamaica Air Shuttle by the Government concerned and for the cost of transporting that Passenger from that country. The fare collected for carriage to the point of refusal or denied entry will not be refunded by Jamaica Air Shuttle and the Carrier may at its sole discretion use the monies paid on unused portions of the applicable ticket as (part) payment of any costs incurred by the Carrier in repatriating the Passenger as directed by the Government concerned.

 

PASSENGER RESPONSIBLE FOR FINES, DETENTION COSTS, ETC.

If Jamaica Air Shuttle is required to pay any fine or penalty or to incur any expenditure by reason of a Passenger’s failure to comply with laws, regulations, orders, demands or other travel requirements of the countries concerned or to produce the required documents, the Passenger shall reimburse Jamaica Air Shuttle on demand, any amount so paid or expenditure so incurred. Jamaica Air Shuttle may apply towards such payment or expenditure the value of any unused carriage on the applicable ticket, or any of the Passenger’s funds in its possession.

 

INTERPRETATION

The title of each Article of these Conditions of Carriage is for convenience only, and is not to be used for interpretation of the text.

 

ADVICE TO INTERNATIONAL PASSENGERS ON LIMITATION OF LIABILITY

Passengers on a journey involving an ultimate destination or a stop in a country other than the country of origin are advised that the provisions of a Treaty known as the Montreal Convention (Convention For The Unification Of Certain Rules for International Carriage By Air – Montreal 28 May 1999)   may be applicable to the entire journey, including any portion entirely within the country of origin or destination
